Creator Contracts in Sri Lanka — Legal Protection Template & Framework

Why Most Sri Lankan Influencer Deals Fail

80% of Sri Lankan influencer partnerships have no formal contract. Most deals are text-based or verbal. Result: content delivered late, non-performance, payment disputes, and brand safety violations. When disputes arise, you have no legal recourse. LVRA's contract framework specifies deliverables, timelines, payment terms, and dispute resolution — protecting both parties and preventing costly conflicts.

Common Issues Without Written Agreements

Unclear deliverables: Creator posts only 2/5 agreed posts. Unclear timeline. Content disputes: You request revisions; creator refuses. No revision clause to fall back on. Payment disputes: Creator demands payment increase mid-campaign. No contract specifying original terms. Brand safety violations: Creator posts inappropriate content damaging your brand. No contract specifying content guidelines. Non-compliance: Creator fails to disclose #sponsored. ASA violation implicates your brand.

“A written contract isn't about mistrust — it's clarity. Both parties know what success looks like.”

Essential Contract Elements

1. Payment Terms & Conditions

Payment amount in currency, payment timing (50% upfront / 50% post-delivery, or 100% upfront), payment method (bank transfer, etc.), and non-refundable clause if deliverables are met. Also specify: what triggers payment, whether revision requests trigger additional fees, and late payment penalties.

2. Deliverables Specification

Exact number of posts (e.g., 5 Instagram reels), video/content length, content types (reels, stories, feed posts), hashtags to include, captions (creator-written vs. brand-approved), and tagging requirements. Specify approval process: creator submits draft, brand approves, creator publishes. Revision limits (e.g., max 2 revision rounds).

3. Timeline & Deadlines

Content submission deadline (e.g., 5 business days before publish date), approval turnaround (3–5 business days), publishing dates (specific dates or windows), and post removal period (how long content stays live). Specify consequences for late delivery (e.g., proportional fee reduction).

Sri Lanka-Specific Legal Requirements

Contractor Status: Influencers are independent contractors, not employees. No benefits, NDA, or statutory holidays required unless specified. Tax Compliance: Creators must declare income to Inland Revenue Board. Include tax language in contract: "Creator responsible for own tax obligations." Advertising Standards: Advertising Standards Authority requires #ad or #sponsored disclosure. Contract must mandate this. Currency: Specify LKR or foreign currency; clarify who bears exchange rate risk.
